Election 2017: IEBC requirements for aspirants

As the forthcoming General Election draws nearer, many individuals are increasingly trying to acquaint themselves with the Independent Electoral and Boundaries Commission (IEBC) requirements for political seats aspirants.

Below is a summary of all the requirements for various political seats.

1. President and Deputy President

Qualifications

  • Must be a Kenyan citizen through birth.
  • Must not have double citizenship.
  • Must not owe allegiance to any other state.
  • Must have the qualifications for election as a member of parliament.
  • Must hold a degree from a university acknowledged in Kenya.
  • Must be a nominee of a political party or an independent candidates.
  • Must be registered to vote.

Requirements

During the commission nominations both party and independent candidates must submit the following documents to the commission either personally or through their authorised agents.

  • Certified copy of national identity card.
  • Certified copy of a degree certificate.
  • For party candidates, a nomination certificate issued by a registered political party and duly signed by an authorized party official, nominating the candidate.
  • One passport size photograph of the presidential aspirant.
  • A fully filled commission nomination form 12.
  • A signed code of conduct
  • A letter of discharge from the employer for aspirants who held a public office, confirming that they were not in employment six months prior to the election.

Independent candidates are required to submit the following:-

  • A symbol, approved by the commission in compliance with section 32 of the elections act 2011, which they intend to use during the election.
  • A clearance certificate by the registrar of political parties confirming that that the aspirant did not ascribe to any political party three months prior to the elections.
  • A fully filled form of intention to contest.
  • Constitute and run a functioning office in Kenya and inform the commission of its physical address for purposes of inspection three months before the elections.

2. Governor and Deputy Governor

Qualifications

  • Must hold Kenyan citizenship for at least 10 years prior to the election.
  • Must not have double citizenship.
  • Must not owe allegiance to any other state.
  • Must hold a degree from a university acknowledged in Kenya.
  • Has to be a registered voter.
  • Must be either nominated by a political party or an independent candidate.

Requirements

Candidates or their authorized agents are required to present the following documents during the commission nominations.

  • A certified copy of the national identity card or a valid passport.
  • A certified copy of a degree certificate as per the elections act.
  • A signed code of conduct.
  • A fully filled commission form 17.
  • A passport size photograph for aspirants vying for the governor position.
  • Letter of discharge from employment, six months before the election, for candidates who were serving in public offices.
  • A nomination certificate signed by an authorized official from a registered political party nominating the party candidate.

Independent candidates should avail the following additional requirements:-

  • Clearance in form of a certificate from the registrar of political parties indicating that the aspirant was not a member of any political party for 3 months before the elections.
  • A symbol to be used by the candidate during the elections which has to be approved by by the commission as per the constitution.
  • An appropriately filled form of intention to contest for the seat.
  • Both hard and soft copies of a list of a minimum of 5000 supporters to be submitted to the county returning officer three months before the election.
  • Found and maintain an operational office in the county where the aspirant is contesting which should be available for inspection by the commission three months to the elections.

3. Member of the Senate

Qualifications

  • Must have been a Kenyan citizen for a minimum of 10 years before the election.
  • Must not be a citizen of another state besides Kenya.
  • Must be a registered voter.
  • Must be a political party nominee or an independent candidate.

Requirements

During the commission nominations both the party candidates and independent candidates are required to submit the following documents to the commissioners.

  • Either a certified copy of the national identity card or valid passport, depending on the document the candidate used to register as a voter.
  • A passport size photograph.
  • A completely filled commission nomination form 16.
  • A nomination certificate from a registered political party signed by an authorized party official for party candidates.
  • A discharge letter from the employer for candidates who held public offices confirming that the person was not in employment for at least six months before the election.

Independent candidates must provide the following additional requirements:-

  • Clearance from the registrar of political parties confirming that the candidate was not a member of any political party for at least three months before the the elections.
  • A symbol which has been approved by the commission as per the elections act in the constitution, to be used by the candidate during the elections.
  • A fully filled form of intention to contest for the seat.
  • Set up and keep a functioning office in the county where the aspirant is contesting and inform the commission of its physical address for purposes of inspection by the commissioners.
  • A list of at least 2000 supporters in the stipulated form in soft and hard copies to be submitted to the county returning officer three months before the elections.

4. Member of the National Assembly & Woman County Representative to the National Assembly

Qualifications

  • Must have been a Kenyan citizen for not less than 10 years before the election.
  • Must not possess dual citizenship.
  • Must not owe allegiance to a foreign state.
  • Must either be nominated by a registered political party or an independent candidate.
  • Must be registered to vote.

Requirements

During the commission nominations, both party and independent candidates or their authorised agents must tender the following documents to the commission.

  • A certified copy of the national identity card or a valid passport depending on the document used by the aspirant to register as a voter.
  • One passport size photograph.
  • A properly signed code of conduct.
  • A fully filled commission form 15.
  • For party candidates, a nomination certificate by a fully registered political party signed by an authorized party official.

Additional requirements for independent candidates include:-

  • A symbol that the aspirant plans to use during the elections which must have been approved by the commission.
  • Clearance by the registrar of political parties clarifying that the candidate was not a member of any political party for 3 months prior to the elections.
  • A fully signed form of intention to contest for the seat.
  • A hard and soft copy of a list of 1000 supporters in the official form to be submitted three months before the elections to the constituency returning officer for candidates vying for national assembly membership and county returning officer for candidates for election as county women representative.
  • Set up and keep a functional office in the electoral area where the aspirant is vying and communicate the physical address to the commission for purposes of inspection three months to the election.

5. Member of County Assembly Ward

Qualifications

  • Must be a Kenyan citizen for a minimum of ten years ahead of the election.
  • Must not hold double citizenship.
  • Must not owe allegiance to any foreign state.
  • Must be registered to vote.
  • Must be either nominated by a political party or an independent candidate.

Requirements

During the commission nominations both party and independent candidates or their authorised agents must hand in the following documents to the commission.

  • A certified copy of either a national identity card or valid passport depending on the document used by the aspirant for voter registration.
  • A passport size photograph.
  • A duly signed nomination certificate from a registered political party for party candidates.
  • For previous public officers, a letter from their former employer confirming that the candidate had left employments six months to the election.
  • A fully filled nomination form 18.
  • A signed code of conduct.

Independent candidates are required to submit the following additional requirements:-

  • A clearance certificate indicating that the candidate was not a member of any political party for the last 3 months to the elections issued by the registrar of political parties.
  • Hard and soft copies of a list of not less than 500 supporters in the recommended form which should be availed to the constituency returning officer 3 months to the election.
  • A symbol, approved by the commission , which the candidate intends to use during the election.
  • Open and sustain a functioning office in the ward the candidate is vying in which should be available for inspection by the commission three months before the election.
